1. Object

1.1 These General Conditions in force, updated in October 2022, are intended, together with the order form, and the other elements referred to therein, to regulate the terms and conditions governing the provision of the Service Wine & Stuff Ldª., headquartered at Rua Camões, n.º 732, 4505-078 Argoncilhe, with the unique registration and identification number of legal person nº 515207373, with a share capital of €5000 (five thousand euros), hereinafter referred to as by Wine & Stuff.

1.2 The purchase of any product in the Wine & Stuff implies acceptance of these General Conditions of Sale Online.

1.3 Any and all alcoholic beverages available for sale in the Wine & Stuff can only be purchased by persons of legal age in their country of residence.

2. Information on Products, Prices and Contents

2.1 Wine & Stuff reserves the right to modify, without prior notice and at any time, the information and commercial offer presented on: products, prices, promotions, commercial conditions and services.

2.2 The images that illustrate each product on Wine & Stuff may differ from the product subsequently delivered, and these same products are also subject to out of stock.

2.3 Harvest YearsWe will send you a more recent harvest year whenever the announced harvest year is not available. Please indicate in the order notes during check-out if you do not wish to change the harvest year. If you are unable to put this in the order notes, we will always accept the return of the product, when agreed between both parties, however, shipping costs are not subject to return, which are the responsibility of the person returning the products. .

2.4 Despite Wine & Stuff, some products from the online store, may have an inaccurate price, which is why before processing orders, all values ​​are verified. Therefore, the prices presented in Wine & Stuff are indicative only and do not constitute a contractual offer. If the actual price of the product is lower than the advertised price, Wine & Stuff will refund the difference. If the price is higher, Wine & Stuff will inform the customer of such situation by email and will await his decision to accept the new price or cancel the order within 15 days from the date the email was sent.

2.5 Under Portuguese legislation, all prices shown on Wine & Stuff include the respective VAT rates in force, unless otherwise stated.

3. Order and Payment

3.1 After confirming the order at Wine & Stuff, an email will be sent to the contact address registered by the customer at the time of formalization, with all details about delivery, billing, payment information, products and values. Wine & Stuff suggests to all customers to confirm the details of the same. If the customer does not receive the order confirmation email, he is requested to contact Wine & Stuff through the contacts available on the winestuff.pt website, so that this notification is sent again to the customer's email address.

3.2 If any of the details placed by the customer in the order are wrong and/or the customer wants to change some information, as long as the order has not yet been shipped, the customer is requested to contact Wine & Stuff through the contacts available on the winestuff.pt website as soon as possible so that the change requested by the customer can be made internally. Changes to details of orders already shipped will have to be analyzed by the Wine & Stuff so that, together with the customer, a more adequate solution can be found.

3.3 All orders at Wine & Stuff will only be processed after receipt of payment. The formalization of the order in itself does not constitute a reservation of the products.

3.4 If an order cannot be partially or fully satisfied, the customer will be immediately contacted by Wine & Stuff in order to find the most suitable solution.

3.5 All orders placed at Wine & Stuff have a maximum payment term of 5 days. After this period, the order will be automatically cancelled.

3.6 Orders may be canceled when expressly requested by the customer through the contacts available on the winestuff.pt website, before the orders are shipped. After confirming the shipment of the order, the customer is asked to contact Wine & Stuff so that, together with it, the most adequate solution can be found.

3.7 Through the Wine & Stuff Payments are accepted through Multibanco Reference (only for customers with a bank account in Portugal), Bank Transfer, Paypal, Credit Card, MB WAY, Cryptocurrencies and Amazon Pay.

3.8 Order status in Wine & Stuff are comprised of 3 phases: Pending, In Processing and Processed.

a) Pending – Waits for the payment to enter the Wine & Stuff;

b) In Processing – Phase in which the payment has already been received, and the order is being processed and in packaging/preparation;

c) Processed – The order has already been dispatched/shipped.

4. Shipping costs

To the prices shown on the products, the respective value of the shipping costs is added for each order, which are calculated based on the sum of two factors: the cost of packaging and the cost of transport. The shipping cost depends on the weight of the order and the respective delivery destination. This postage value can be simulated inside the shopping cart with the desired products added and filling in all the requested fields of the simulator, after which the Options for each shipment will be presented. The total shipping costs will also be automatically calculated when placing your order in the Online Store. It should be noted that the factors of this calculation may be variable and change without prior notice.

Shipping offer to Portugal and Spain for purchases over €80. For the Azores and Madeira Islands, shipping is offered on purchases over €130.

5. Shipments and Deliveries or Pickup at Wine & Stuff

5.1 For orders to be sent to the requested address, the shipping option must be chosen – National Shipping (in case of Portugal) and International Shipping (in case of other countries outside Portugal) .

5.2 In general, after dispatch, an order with Wine & Stuff delays to be delivered:
– Between 2 to 4 working days for Mainland Portugal;
– Between 8 to 14 working days in Madeira Islands and Azores;
– Around 4 to 6 working days in Peninsular Spain;
– Around 6 to 10 working days in the rest of Europe;
– Approximately 20 working days in the rest of the world;.

5.3 After the orders are dispatched, the information for monitoring the shipment will be available in the account of the customers who have placed the order with registration and a notification is also sent via email with the information of the link for monitoring the shipment to all customers registered and unregistered. If for some reason the customer does not receive the shipment confirmation, he is requested to contact Wine & Stuff through one of the contacts available on the winestuff.pt website so that all available information about the shipment of the order can be sent again.

5.4 After notification of shipment, customers must follow the status of the shipment through the link provided by Wine & Stuff, so that they are aware of the state of evolution until the moment of delivery of the order, since Wine & Stuff does not notify each shipment status change.

5.5 All products shipped by Wine & Stuff must be checked upon delivery. If the customer finds that the order is damaged, he must immediately return it to the transport company, duly justify the reason for the return in the carrier's packing slip and immediately notify Wine & Stuff through one of the contacts available on winestuff.pt. The carrier must be informed of breakages at the time of delivery. We do not accept any requests for breakages or shortages of products unless they are registered in the carrier's documentation.

5.6 If, after delivery, the customer finds that any of the items is not in conformity, he is requested to contact immediately with Wine & Stuff via email geral@winestuff.pt indicating the order number or the number of the document that accompanied the order, attaching images of the packaging as received and of all the articles, so that the process of investigation of the occurrence can be opened internally. and in this way the situation can be resolved as soon as possible. Breakage requests will only be accepted if we are notified within 24 hours after delivery. Damaged products and their packaging will need to be stored in case a check is required. 

5.7 Wine & Stuff is not responsible for shipments made to countries where the respective law does not allow the entry of alcoholic beverages. Customers are responsible for the eventual seizure of their orders, as well as the payment of customs fees, if any. In case of return of products to Wine & Stuff will only refund the amount corresponding to these same products. In case of doubt, the customer may contact Wine & Stuff before ordering.

5.8 A Wine & Stuff has contracted services with specialized carriers for the purpose of deliveries in Portugal, Europe and most countries in the world. Every effort is made to comply with shipping and delivery deadlines, however it should be noted that possible delays in deliveries may be unrelated to Wine & Stuff, and in these cases it is not possible to guarantee exact delivery times.

5.9 Most deliveries are made during business hours on working days at the shipping address indicated by the customer when submitting the order.

5.10 In case of unsuccessful delivery attempt by the transport company due to absence, a notice of passage is always left in the customer's mailbox with the carrier's indications. Depending on the service and the carrier, orders must be collected at the place indicated by the same in the ticket notice, or the directions requested in the same notice must be followed.

5.11 If for some reason the customer cannot receive the order or pick it up at the location indicated by the carrier, the customer is requested to contact Wine & Stuff so that together we can find the most suitable solution.

5.12 ​​Before submitting the order, if the customer wants to collect it from our warehouse, he/she must select the shipping option ''Pickup in Store '' – our physical facilities located at Rua de Camões, n.º 732, 4505-078 – Argoncilhe will be automatically assumed.

a) Only the person whose name is described in the note will be authorized to pick up the order order, unless it communicates in advance to Wine & Stuff that someone else (identifying the name) will pick up the order.
b) Orders for pick up in store may take 1 business day to be processed, all customers are notified via email when they are available to be collected.
c) When going to Wine & Stuff, the customer must accompany the order confirmation/number, ensuring that he has received our order confirmation notification available for collection, and thus avoid unnecessary travel.

6. Returns

6.1 Wine & Stuff recognizes to all its customers the right to terminate the contracts they enter into with it, allowing them to return, within a period of 14 (fourteen) days, the products purchased under the terms of Decree-Law n.º 143/2001 and Decree -Law 82/2008 of 20/05.

6.2 To request an exchange or return, the customer is requested to contact Wine & Stuff via email geral@winestuff.pt indicating the order number or the number of the document that accompanied the order, taking into account the conditions described below in the following topics:

a) To return the order, the product must be in perfect condition, and if applicable with its original packaging, accessories or promotional offers included, and accompanied by proof of purchase or invoice.
b) Return of products will be accepted. defective and wrong shipments, being Wine & Stuff for shipping and collection costs whenever the customer communicates this circumstance within a period of 14 (fourteen) days from the date of receipt of the product.
c) Once the goods have been received at our facilities and after validation of the accordingly, the amount will be refunded according to the payment method made by the customer, or another solution previously agreed with the same.

6.3 Wine & Stuff assumes the responsibility arising from defects in origin or raw material of the product purchased and if this is confirmed by the specialized team of Wine & Stuff will exchange or return the product at no cost to the customer.

6.4 Wine & Stuff will not accept the return of the product after it has been used, or if it has been altered or modified.

6.5 Wine & Stuff is not responsible for deficiencies resulting from incorrect use, negligence, poor storage conditions or force majeure.

7. Age Restrictions

By placing an order you are confirming that you are of legal drinking age in your country. If the delivery company is in doubt about the age of the recipient of an order they will ask for some form of identification. In the event that this is not satisfied they are not allowed to leave the order.

8. Fraud and Crime Prevention

For the purposes of preventing or detecting offences, and/or apprehending or prosecuting criminals, we may have to share any information we collect with the police, other public or private sector agencies or representative bodies in accordance with the relevant legislation. Information shared in this way will not be used for marketing purposes.

9. Data Protection

The Wine & Stuff will take all reasonable precautions to keep your order and payment details secure, but unless the Company is negligent, Wine & Stuff will not be responsible for unauthorized access to information provided by you. We will only use the information provided about you for the correct fulfillment of your order. The Company will inform you about products and offers that may be of interest to you from time to time and through its newsletter. If you do not wish to be informed of these offers, please send an email to winestuff@winestuff. en indicating in the e-mail the request to unsubscribe from our newsletter. You can correct or delete any information about yourself by logging into your customer account in the "My Account" area or by contacting us at winestuff@winestuff.pt

10. Third Party Websites

As a convenience to customers, the Company's website includes links to other websites or materials that are beyond its control.

11. Advertising and Sponsorship

Part of the company's website may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Company's website complies with relevant laws and codes. We will not be responsible for any errors or inaccuracies in advertising and sponsorship material.

12. Applicable Law

12.1 All purchases made on the Wine & Stuff are subject to Portuguese legislation. Any conflict or divergence of interpretation of the General Conditions of Sale Online will be submitted to the competent Portuguese Court.

12.2 If the Customer is outside mainland Portugal, Wine & Stuff hereby informs you that any legal process must be brought exclusively in the Portuguese Courts.

12.3 Under the terms and for the purposes of the provisions of art. 18 of Law n.º 144/2015, of 8 September, it is hereby informed that the ADR entity available is the Consumer Conflict Arbitration Center of Porto, with the following contacts:
